1. Introduction
Welcome to VybeVerse. These Terms of Service ("Terms") govern your use of the VybeVerse website at vybeverse.comand all related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
VybeVerse ("we", "us", "our") is operated from the United Kingdom.
2. Eligibility
You must be at least 18 years of age to use VybeVerse. By using the Platform, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.
3. What VybeVerse Provides
VybeVerse is a creator platform that provides tools for digital creators to build their online presence, sell digital products, and grow their audience. We provide the infrastructure — creator profiles, product hosting, payment processing (via Stripe), secure file delivery, and audience management tools. Creators from the United Kingdom and United States can receive payments through Stripe Connect.
VybeVerse is a platform provider and does not create, endorse, or guarantee the quality of any content or products listed by creators. We are not a party to transactions between creators and buyers.
4. Account Types and Registration
4.1 User Accounts
Anyone can create a free account to view creator profiles, purchase digital products, follow creators, and manage their purchases. Authentication is handled through Clerk.
4.2 Creator Accounts
To sell digital products on VybeVerse, you must subscribe to a creator plan (Starter or Pro). Creator subscriptions are billed monthly or annually via Stripe. Creators keep 100% of their product revenue — VybeVerse charges zero sales commission. Creator accounts are currently available to individuals and businesses based in the United Kingdom and United States.
4.3 Account Security
You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must notify us immediately at support@vybeverse.com if you suspect unauthorised access to your account.
5. Creator Subscriptions
Creator plans are subscription-based, billed through Stripe on a monthly or annual cycle. By subscribing, you authorise recurring charges to your payment method.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel your subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — you retain access until then.
- Upon cancellation, your published products will be set to draft and your creator profile will no longer be publicly accessible. Your data and products are preserved and can be restored by resubscribing.
- We offer a 7-day free trial on monthly creator plans for new subscribers. At the end of the trial, your subscription will begin and you will be charged unless you cancel before the trial ends. Free trials are not available on annual plans or for returning creators who have previously subscribed.
- We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect on their account.
6. Purchases and Payments
When you purchase a digital product through VybeVerse, the payment is processed by Stripe. The transaction is between you (the buyer) and the creator who listed the product. VybeVerse facilitates the transaction but is not a party to it.
All prices are displayed in USD. Buyers are responsible for any applicable taxes, foreign exchange fees, or charges imposed by their payment provider. Creators are solely responsible for determining, collecting, and remitting any applicable taxes on their product sales in accordance with the laws of their country of residence. VybeVerse does not provide tax advice and does not withhold or remit taxes on behalf of creators.
7. Digital Product Delivery
Upon successful payment, digital products are made available for download through your purchases page. Files are delivered via secure, time-limited download URLs. Some products may be delivered via external links provided by the creator. You receive lifetime access to re-download purchased products through your account.
8. Creator Responsibilities
As a creator on VybeVerse, you agree that:
- You own or have the necessary rights and licences to all content and products you upload and sell.
- Your products do not infringe any third-party intellectual property, copyright, trademark, or other proprietary rights.
- Your products and content comply with all applicable laws and regulations.
- Product descriptions are accurate and not misleading.
- You are solely responsible for the quality, legality, and fulfilment of the products you sell.
- You are responsible for handling buyer enquiries and support requests related to your products.
- You comply with Stripe's terms of service for receiving payments via Stripe Connect.
- You comply with all applicable laws in your country of residence, including tax obligations on income earned through the Platform.
- You are solely responsible for determining, collecting, and remitting any applicable sales tax, VAT, GST, or other taxes on your product sales. VybeVerse does not calculate, collect, or remit taxes on your behalf.
9. Prohibited Content and Conduct
You may not use VybeVerse to upload, sell, or distribute:
- Content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Content that infringes on intellectual property or copyright of others
- Malware, viruses, or any harmful code
- Fraudulent, misleading, or deceptive products or descriptions
- Content that exploits or harms minors in any way
- Sexually explicit or pornographic material
- Content that promotes hatred, violence, or discrimination
We reserve the right to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.
10. Intellectual Property
10.1 Your Content
You retain full ownership of all content and products you upload to VybeVerse. By uploading content, you grant us a limited, non-exclusive licence to host, display, and distribute your content solely for the purpose of operating the Platform (such as displaying your profile and product pages to visitors).
10.2 VybeVerse's Intellectual Property
The VybeVerse name, logo, design, and underlying technology are our intellectual property. You may not copy, modify, or distribute any part of the Platform without our written permission.
10.3 Buyer Licence
When you purchase a digital product, you receive a limited, non-exclusive, non-transferable, personal licence to use that product for your own purposes. You may not resell, redistribute, or share purchased products unless explicitly permitted by the creator. The creator retains all intellectual property rights to their products.
11. Limitation of Liability
VybeVerse is provided on an "as is" and "as available" basis. To the maximum extent permitted by UK law:
- We do not warrant that the Platform will be uninterrupted, error-free, or secure.
- We are not responsible for the content, quality, safety, or legality of products listed by creators.
- We are not liable for any disputes between buyers and creators.
- We are not liable for any loss of revenue, profits, or data experienced by creators or buyers.
- Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you have paid to VybeVerse in the 12 months preceding the claim.
- We are not liable for any indirect, incidental, special, or consequential damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.
12. Copyright Complaints
If you believe that content on VybeVerse infringes your copyright or intellectual property rights, please contact us at legal@vybeverse.com with the following information:
- A description of the copyrighted work you claim has been infringed
- The URL or location of the allegedly infringing content on our Platform
- Your contact information (name, email, address)
- A statement that you have a good faith belief that the use is not authorised by the copyright owner
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
We will review all valid complaints and take appropriate action, which may include removing the infringing content and/or suspending the creator's account.
13. Account Termination
You may delete your account at any time by contacting us at support@vybeverse.com. We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. Upon termination, your right to use the Platform ceases immediately. Any outstanding creator subscription charges remain payable.
14. Indemnification
You agree to indemnify and hold VybeVerse harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your content, your products, your violation of these Terms, or your violation of any applicable law including tax obligations.
15. Third-Party Services
The Platform integrates with third-party services including Stripe (payments), Clerk (authentication), Cloudinary (file storage), Xano (backend infrastructure), Vercel (hosting), Cloudflare (domain and bot protection), Sentry (error monitoring), CookieYes (cookie consent management), Google Analytics (web analytics), and PostHog (product analytics). A complete list of third-party services and how they handle your data is available in our Privacy Policy. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or performance of third-party services.
16. Disclaimers
VybeVerse does not review, verify, or endorse any products or content listed by creators. We do not guarantee that products will meet your expectations, be error-free, or produce any particular results. Any reliance on creator content or products is at your own risk.
We do not provide legal, tax, financial, or professional advice. Creators and buyers should seek independent professional advice where appropriate.
17. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Before pursuing formal legal action, both parties agree to make a good faith effort to resolve any dispute through direct communication via legal@vybeverse.com.
18. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. For material changes, we will make reasonable efforts to notify you via email or through the Platform at least 14 days before the changes take effect. Your continued use of VybeVerse after changes are posted constitutes acceptance of the updated Terms.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and VybeVerse regarding your use of the Platform and supersede any prior agreements.
